An LLC and an EIN often appear in the same startup checklist, but they solve different problems. Understanding the distinction helps you order the right service, avoid duplicate work and keep the correct documents available when a provider asks for them.
The LLC is the business structure
An LLC is created under state law. Its formation documents establish the entity's legal identity. Owners are called members. The state's formation record is different from the federal tax identification assigned by the IRS.
The EIN is a tax identification number
An EIN identifies an entity for federal tax administration. Entities other than LLCs can also have one. Obtaining a number does not create a limited liability company, register its name with a state or replace its formation documents.

Which comes first for a new LLC?
Organize the state formation first so the company information used for the EIN is settled. Maintain one reference sheet with the approved name and other official details. The IRS advises forming a legal entity with the state before requesting its EIN.
If you already have a business, start by checking its records. Do not order a second company simply because you cannot find an EIN letter. Tell your provider what already exists and what is missing. The right next step may be a records or application review rather than a new formation.
Does every single-member LLC need its own EIN?
The answer depends on the applicable tax and operational requirements. Do not assume that having one owner eliminates all EIN or reporting obligations. A bank may also request business identification as part of onboarding. Review the official requirements for your own situation rather than copying another founder's checklist.
Keep your launch documents organized
Create separate folders for formation, tax correspondence, banking, contracts and customer-facing materials. Label files clearly, restrict access and keep a secure backup. When a bank asks for proof of formation, send the relevant state document rather than assuming the EIN confirmation answers the request.
Your public website serves a different audience. Visitors need to know what you sell, how to contact you and what happens after they buy. Do not publish sensitive tax or identity documents on the website in an attempt to demonstrate legitimacy.
