Starting a US LLC from abroad becomes easier when you separate the launch into clear decisions: where to form, what information to prepare, how to obtain your tax identification number and how to present the business to customers. This guide helps you organize those decisions before paying for a filing.

Can a non-US resident own a US LLC?

In many cases, yes. The IRS notes that most states do not restrict LLC ownership and permit foreign owners. Your business activity and the selected state's rules still matter. Company ownership does not itself grant immigration status or permission to work physically in the United States.

1. Describe your actual business

Write a short description of what you sell, who buys it and where the work happens. A remote design agency, an online store holding US inventory and a local service business have different operational needs. List owners, expected locations and any employees before comparing formation packages.

For example, a designer serving clients online should prepare a clear service description and sample work. A store should also document products, suppliers, delivery areas and return procedures. These details will be useful well beyond the formation stage.

2. Choose a state for your circumstances

Compare initial costs, recurring administration and where the business will operate. Do not choose a state solely because a video calls it the cheapest. Ask a qualified adviser whether your activities require registration in another state as well. Use our Wyoming versus Delaware comparison to structure the conversation.

3. Prepare the name, addresses and ownership details

Choose a proposed legal name and a backup. Keep the spelling consistent across your records. Identify the registered agent and distinguish its address from your actual operating and mailing addresses. Gather owner identification and the information requested by your formation provider.

Agree with any co-owners on ownership percentages, responsibilities and how decisions will be made. Have the appropriate operating agreement prepared for your circumstances rather than leaving these questions until a disagreement arises.

4. Complete formation, then organize your EIN application

The state formation filing and the IRS EIN application are separate steps. Keep the approved company documents together so subsequent applications use the same legal information. Read our LLC versus EIN guide if the two processes are still unclear.

5. Prepare banking and your customer-facing launch

Review banking and payment-provider eligibility before relying on a particular account. Prepare a website that explains your offer, a professional contact method, and clear customer policies. An LLC filing alone does not tell customers why they should buy from you.

  • Store formation and tax documents securely.
  • Track application status and outstanding information requests.
  • Prepare service descriptions, pricing and a contact page.
  • Set reminders for professional compliance reviews and renewals.
